These Terms govern the Beneficiary's use of the Lifestyle Concierge Platform and the booking of the services offered by independent Service Providers. Creating an account, completing a booking or pressing the consent button is deemed acceptance of these Terms and of the policies associated with them.

Service Provider: the establishment or independent professional accepted on the Platform that offers the Service and performs it for the Beneficiary.
Service: women's beauty services, non-medical cosmetic services, personal care, barbering, light sports such as Pilates, professional photography, and similar services that are permitted to be offered.

Payment Service Provider: the licensed entity that undertakes the processing of electronic payments when payment through the Platform is made available.
Policies: the Privacy Policy, the Booking, Cancellation and Refund Policy, the Payment Policy and any controls announced and accepted at the time of booking.
The Platform enables Service Providers to offer their services, and enables the Beneficiary to view, book and manage them, and may enable their value to be collected by a licensed Payment Service Provider.
The Platform acts as an electronic intermediary; it does not provide the Service that is the subject of the Booking and does not operate a medical or health facility. The contract for the provision of the Service is concluded directly between the Service Provider and the Beneficiary upon confirmation of the Booking.
The Service Provider bears responsibility for the description of the Service, its performance, quality and safety, its licences and its personnel. This allocation does not relieve the Platform of any obligation that may not be excluded under the applicable laws.
Medical, therapeutic or medical cosmetic services may not be offered or booked through the Platform, and the prohibited matters include procedures that require a health licence, a diagnosis, a therapeutic prescription or a medical intervention.
In order to use the account, the Beneficiary must have full legal capacity and be not less than eighteen years of age. The Beneficiary may make a booking for a minor for whom he or she is legally responsible, subject to the Service Provider's requirements.
Electronic consent and the records and messages issued by the Platform are deemed evidence in proving the request and the acceptance, subject to the Electronic Transactions Law.
If a person uses the Platform on behalf of an establishment, that person acknowledges that he or she has the authority to bind it to these Terms.
The Beneficiary undertakes to provide correct and up-to-date data, not to impersonate others, and to maintain the confidentiality of the verification code and login details.
The Beneficiary bears responsibility for the transactions executed from his or her account until he or she notifies the Platform, without delay, of any unauthorised use. The Platform's team does not request the password or the full card data through means of communication.
The Platform may request identity verification where there is a legitimate suspicion of misuse or where this is required by law, provided that the request is limited to the necessary data.
The Platform provides basic booking management free of charge according to the announced plan or features. The use of these features does not depend on purchasing an additional service unless the contrary is clearly shown before subscription.
Optional additional features or subscriptions may be offered for a consideration, and the description of each feature, its price, the subscription period and the method of renewal and cancellation shall be shown before purchase.
No paid subscription shall be renewed and no recurring fees shall be debited except on the basis of express and provable consent, and the subscriber may stop future renewal through the announced means.
The Service page shall display the name of its provider, its description, its price, the taxes and fees shown, its duration, its location, the available appointments, the cancellation conditions and the material information necessary for making the booking decision.
Choosing an appointment is not deemed a confirmed booking until the confirmation notice has been issued and payment has been completed, if required. If confirmation is not possible, no obligation to perform the Service arises.
The Beneficiary undertakes to review the booking details before approving it and to attend at the specified time and place. Lateness or no-show is subject to the Booking, Cancellation and Refund Policy displayed before confirmation.
A booking may be made for another person, on condition that that person's data is correct and that he or she consents to the sharing of whatever is necessary to perform the booking; the account holder remains responsible for the request and the amounts connected with it.
The final price, fees and taxes are shown before the Booking is confirmed. No fees are due that were not disclosed on the payment screen or in the booking confirmation.
Payment may be electronic or at the Service Provider, according to the option displayed. Electronic payments are processed by a licensed Payment Service Provider, and the Platform does not ordinarily retain the full card data.
The Platform or the Payment Service Provider is entitled to decline the transaction or to request additional verification where fraud is suspected, authorisation is not possible or the legal requirements are contravened.
Vouchers and offers are subject to their announced conditions, and may not be converted into cash, misused or combined with other offers unless so provided.
The Service Provider shall perform the Booking in accordance with the description, the appointment, professional standards and the statutory requirements, and shall be responsible for answering technical questions relating to the Service and its suitability for the Beneficiary.
The Beneficiary must inform the Service Provider directly, before performance, of any information necessary for safety, such as allergies or physical limitations, and must not enter health or sensitive data in the Platform's general fields unless the Platform requests it for a specific purpose and on a legal basis.
The general information or content published on the Platform does not constitute medical or therapeutic advice, and the Beneficiary must consult a licensed specialist when needed.
The Service Provider may refuse to perform a Service if its performance is unsafe, contrary to the laws or outside the scope of its licence, with the refund provisions applied according to the reason for the refusal.
The Booking, Cancellation and Refund Policy and the booking conditions displayed before confirmation shall apply, and are deemed part of these Terms.
If the Service Provider cancels the Booking or is unable to perform it, the Beneficiary is entitled, at his or her choice, to be refunded the amount paid for the cancelled Service or to accept an alternative appointment.
Amounts shall be returned to the original payment method, unless that is not possible or the Beneficiary expressly agrees to another method. Bank processing may take the period announced by the Payment Service Provider.
The cancellation provisions shall not be interpreted in a manner that diminishes a right established for the consumer under the E-Commerce Law or any applicable law.
The Beneficiary may submit a complaint via hello@lifestyleconcierge.sa within 1 day of the date of the Service, together with the booking number, a description of the incident and the supporting documents.
The Platform may refer the complaint to the Service Provider, request the necessary records and verify the performance of the Booking. The Platform's involvement in the settlement is not deemed an acknowledgement that it provided the Service.
The Platform may take the appropriate measure according to the outcome of the verification, including returning the amount or part of it, granting credit with the Beneficiary's consent, or suspending the Service Provider, without prejudice to the statutory rights of the parties.
A review must be truthful and related to an actual experience, and must not contain abuse, defamation, the personal data of third parties or content contrary to the laws.
The Beneficiary grants the Platform a non-exclusive, royalty-free licence to display the content he or she provides within the Platform to the extent necessary to operate and improve it, with ownership of the content remaining with the Beneficiary.
Content may be deleted or blocked if it contravenes these Terms or if a credible report is received concerning it, while preserving its owner's right to object through the announced channel.
Making fictitious or repeated bookings with the intention of causing harm, or reserving appointments without the intention of using them.
Circumventing prices, offers, payment methods or review systems.
Attempting unauthorised access to the Platform or to the accounts of others, disrupting the systems, or extracting data by automated means without authorisation.
Using the data of Service Providers or Beneficiaries outside the purpose of the booking or in order to send unsolicited messages.
Requesting or providing prohibited, medical or therapeutic services through the Platform.
Publishing content that is unlawful or that infringes intellectual property rights or privacy.
The rights in the Platform, its software, design, trademarks, databases and original content belong to the Platform Owner or its licensors.
The Beneficiary is granted a limited, personal and revocable right to use the Platform for its intended purpose, and copying, reverse engineering, reselling or creating a competing service in reliance on its content is not permitted without written consent.
The trademarks and content of the Service Providers remain the property of their owners, and their display does not mean that ownership of them has passed to the Platform or to the Beneficiary.
The Platform processes personal data in accordance with the Privacy Policy and the Personal Data Protection Law and its regulations, and the Policy is deemed an integral part of these Terms.
The operational messages necessary for the account, the booking and security may be sent, and these messages are not deemed marketing. Marketing messages, however, are subject to consent and to the unsubscribe options.
The Beneficiary bears responsibility for updating his or her mobile number and email address so that notifications of bookings and changes reach him or her.
The Platform exercises reasonable care to make itself available and to protect its continuity, and it may be temporarily interrupted for maintenance or for technical or security reasons or reasons beyond control.
Features may be modified or a non-essential feature discontinued, with appropriate notice wherever this has a material effect. The discontinuation of a feature shall not affect a confirmed booking except for a legal, security or force majeure reason.
The Platform shall not be liable for the act of the Service Provider or for the quality of its service, except to the extent that liability arises from an act or default directly attributable to the Platform or is prescribed by law.
No exclusion or limitation of liability shall apply to fraud, gross negligence, bodily injury, breach of personal data or any liability that may not be excluded by law.
Subject to the preceding paragraph, a claim against the Platform shall be limited to foreseeable and established direct damage, and shall not include indirect losses or loss of opportunity that the Platform did not directly cause.
The Beneficiary may request the closure of his or her account, with prior obligations, bookings and claims remaining in accordance with the laws and the Privacy Policy.
The account may be suspended or restricted upon a contravention of the Terms or a reasonable suspicion of fraud or a security risk, and the Beneficiary shall be notified of the reason wherever notification is permissible and does not prejudice the investigation.
Suspension shall not in itself result in the forfeiture of a right due to any party or prevent a refund that is required by law.
These Terms may be updated in order to keep pace with legal requirements or the development of the service. The update shall be published together with its effective date, and the user shall be informed of any material change by the appropriate means.
An amendment that prejudices the rights attaching to a confirmed booking shall not be applied retroactively, unless that is necessary in order to comply with a law or a binding decision.
The Platform's notices shall be sent to the registered contact details or shall appear within the account.
A complaint shall be handled within the announced period, and the Beneficiary may resort to the competent authority if no settlement is reached or if he or she has a statutory right to do so.
These Terms are governed by the laws of the Kingdom of Saudi Arabia.
The parties shall endeavour to settle the dispute amicably; if that is not possible, the competent judicial authority in the Kingdom shall have jurisdiction over it, without prejudice to the mandatory rules of jurisdiction and the rights of the consumer.
If any provision of these Terms is void or unenforceable, the remainder shall remain in force to the extent that it does not conflict with the mandatory provision.
